Is this tampering with a witness?

my husband has a custody trial coming up to change custody of his children to where he is sole custiodian. Right now custody is 50/50 with no primary custodian. she has failed drug tests, been arressted twice in the past 60 days and always leaves the kids with her mother on her week to have them. She has no job, no home, no liscence, no way to provide for the children. she just went through another divorce and her other ex husband was granted full custody of her other child based on evidence of her drug use, and evidence that he had to prove that she never took care of the child. we had a pre trial conference with the judge, he set up a trial date and asked both her and my husband to turn over the names of the witnesses that they planned to call. my husband said me, her ex husband, and his new wife. subenoas where handed out to make us all offical witnesses. Since then my husbands ex wife threaten to kill the new wife of her other ex husband (who is a witness) causing the new wife to get granted a restraining order. my husband's ex wife's mom then made false alligations against our witness to have her arressted. (these charges where dropped by the state.) Now my husband's ex wife went and got an EPO against her other ex husband on bogus charges. she claims he drove by her house 14 times the other night, and it is not true because i was on the phone with this man during the time she claims this happened (and it was his home phone not his cell phone. we were talking about the upcoming case.) She obtained the EPO after the judge told her that if she didn't return the other child by a specific time then he would have her arressted for kidnapping. (she lives in another county and got the judge to sign it from the county that she lives in, not by the judge who determined custody) With this EPO in place our witness can not be anywhere near her, and he is suppose to testify for us before the court date for the EPO, but the EPO is bogus. Due to her doing all of this to our witnesses could that be considered tampering with a witness? If so who would press the charges, us or our witnesses?
